Terms of Service

Commissions

Permission

  • My work is for personal use only (such as a gift to a friend or oneself, a profile picture, to stick up a picture in one’s room, etc). Never should my work be sold or advertised (this includes printing my work on mass-produced goods or selling digital copies, as well as website ads).

  • Commissioned pieces are allowed to be reposted on the client’s socials as long as I am clearly credited as the creator (either in the caption of a post or in a bio if my art is used as a profile picture).

  • Commissioned artworks may be posted to my social media or website.

  • I have the right to deny any requests I deem too inappropriate or out of my range of work.

  • People (you, fanart and OCs)
  • Short comics
  • Scenes
  • Illustrative style (similar to that of anime/cartoons)
  • Rough landscapes
  • Mild NSFW
  • Animals/Furries
  • Mecha, vehicles, architecture
  • Realism
  • Replicating another franchise/creator's artstyle

General

  • Commissions take anywhere from 1 – 4 weeks depending on my availability and the complexity of the artwork. Given this, clients that need me to finish a piece for a specific deadline should ask 1 – 4 weeks in advance so I have enough time.

  • Clients should send me at least 3 reference images (e.g. colour palette, poses, original character sheets, etc).

  • Clients are allowed to add to the commission at any point of the process (e.g. pay for a background or a secondary character) but the finish deadline will be extended depending on the complexity of the add-on.

  • To commission me, either fill out my commission form or reach out to me on social media and we can arrange a slot for you.

Payments, Refunds and Revisions

  • Payments will be made either through PayPal or my Ko-fi (the ko-fi website sometimes defaults to euros so clients should be careful when entering the price as they may end up spending more than intended!).

  • Payments will be made upfront.

  • Full refunds are only accepted if I haven’t started sketching a client’s commission. I can offer a 50% refund if I am still in the early stages of the commission (e.g. sketching stage). Clients cannot refund pieces that are/close to being completed.

  • Revisions are free of charge as long as they are requested within a week of completion. Anything later will have a revision fee of £10. Revisions are limited to 3 per commission.

Licensing My Art

General

  • It is intended for independent/small business products and does not give the right to high volume mass production.

  • The price of the license varies from £25 – £100 depending on the type of products my work will be reproduced on as well as how many will be made. We can negotiate estimated prices via e-mail. Therefore, to purchase a license, please contact me.

  • I will personally send you a copy of the license via e-mail for you to sign and send back to me.

  • Because this is a license, as a Grantee, you are only to pay a flat fee; no royalties.

  • You can only license an existing image; if you want a custom illustration you will have to commission me first (which can range from £15 – £100) and then purchase the license on top of that.

Contract Agreements

The following agreements have been copied directly from the licensing contract:

  • This grant permits the Grantee the exclusive right to manufacture, distribute, and sell the merchandise. Further, the artist grants the Grantee the right to reproduce the image on the Grantee’s website and all other Grantee promotional materials.

  • The term of this contract is for one calendar year, commencing upon both parties signing this contract.

  • During the term of the contract, the Artist agrees that he/she will not make or sell or distribute forms of the image that is the subject of this contract.

  • The Artist shall retain all copyrights in and to the image. The Grantee shall identify the Artist as the creator of the image on the licensed products and shall reproduce thereon, a copyright notice for the Artist which shall include the word “Copyright” or the symbol for copyright “©”, the Artist’s name, and the date and year of the first publication.

  • The artist understands that all profits from the sale of the Artist’s merchandise will benefit the Grantee. 

  • The Grantee shall give to the Artist, at no cost to the Artist, [Product Type] of the licensed products, for the Artist’s personal use.

  • The Artist shall have the right to approve of the quality of the reproduction of the image on the licensed products and the Artist agrees not to withhold approval unreasonably.

  • The Grantee will sell the licensed products in [Location of Sale of Licensed Products]; however, the Grantee will not be the Artist’s agent or promoter.

  • The Artist shall indemnify and hold the Grantee harmless from and against any loss, expense or damage occasioned by any claim, demand, suit or recovery against the Grantee, arising out of any alleged use of the image which violates or breaches a third party’s property rights.

  • Neither party shall assign rights or obligations under this agreement.

  • This agreement constitutes the entire agreement between the parties hereto and shall not be modified, amended or changed in any way except upon a written agreement signed by both parties.
